GENERAL CONTRACTING TERMS AND CONDITIONS

1. PARTIES AND ACCEPTANCE OF THE GENERAL CONTRACTING TERMS AND CONDITIONS:

(hereinafter also the General Terms and Conditions or GTC):

On the one hand, the provider of the management of accommodation booking services at the campsite, ECOTUR CALELLA, SL, whose commercial name is CAMPING CALELLA DE PALAFRUGELL (hereinafter also, the provider, with registered office at C/Chopitea 110, 17210, Calella de Palafrugell, Girona, and Tax Code [NIF] B17007857, customer service telephone number 972.615.116, and e-mail address: info@campingcalelladepalafrugell.com, owner of the website www.campingcalelladepalafrugell.com, hereby submitting the contractual document that will govern bookings through the said website.

And on the other hand, the User - Client (hereinafter, the User), who makes the booking and is responsible for the truthfulness of their personal data provided to the provider.

BOTH parties Accept this document, which implies that the user:

a. Has read and understood what is stated herein.

b. Is a person of legal age and with sufficient capacity to enter into contracts.

c. Accepts all of the obligations stated herein.

d. Has read and accepts these general purchase terms and conditions from the moment they make a booking.

This document may be printed and kept by Users.

The provider makes the e-mail address info@campingcalelladepalafrugell.com available to them so that they can raise any questions about these terms and conditions.

These terms and conditions will have an indefinite period of validity and will be applicable to all contracts made in person, telephone, e-mail or through the provider's website www.campingcalelladepalafrugell.com.

In order to improve the services offered, the provider reserves the right to unilaterally modify said General Terms and Conditions, without this affecting the bookings or promotions acquired before the modification. In any case, before proceeding with a booking, these general terms conditions must be consulted.

It is advisable that you keep a copy of the information contained in the booking receipt. CAMPING CALELLA DE PALAFRUGELL is not responsible for any loss of data, files or any damage resulting from a failure by the User to backup the data contained in the booking receipt.

The civil liability of CAMPING CALELLA DE PALAFRUGELL for the services provided is limited to the amount thereof, the user renounces to claim any liability to CAMPING CALELLA DE PALAFRUGELL for any reason in any case of dissatisfaction of the services acquired by telephone, in person, e-mail or on the website www.campingcalelladepalafrugell.com, as well as possible failures, slow access or errors in accessing the website, including loss of data, or other information that may exist on the computer or network of the user who accesses the website www.campingcalelladepalafrugell.com.

CAMPING CALELLA DE PALAFRUGELL is a company specialised in providing accommodation rentals at the campsite. CAMPING CALELLA DE PALAFRUGELL offers remote camping accommodation rentals over the Internet through its website and/or by phone, e-mail, or in person at the camping facilities located at C/Fuenteventura s/n, 17210, Calella de Palafrugell, Girona.

2. Subject matter of the Contract:

2.1. Scope of application: The subject matter of this contract is to regulate the contractual relationship of making an accommodation available by the provider under a certain price and booking and payment of the same by the user at the time the user accepts these booking terms and conditions, during the online contracting process, by checking the corresponding box or receiving them via e-mail in case of telephone or on-site contracting. These GTC will apply from the day the booking is made.

The aforementioned contractual relationship entails the delivery, in exchange for a given price publicly displayed through the website, at the time of making a specific booking.

2.2. Territory of application: Bookings through the website www.campingcalelladepalafrugell.com are active worldwide.

2.3. Capacity to enter into contracts: In order to carry out bookings, you must be of legal age and have the capacity to enter into contracts.

2.4. Customer acceptance: Booking validation through the website www.campingcalelladepalafrugell.com is made by e-mail and also implies the automatic acceptance of the GTC. These terms and conditions are available on the website www.campingcalelladepalafrugell.com or, if you wish and request, we can make them available to you by e-mail.

2.5. Modification of the General Contracting Terms and Conditions: CAMPING CALELLA DE PALAFRUGELL reserves the right to make changes and/or modifications to these GTC. We advise our clients to review them regularly. In the event that changes or modifications are introduced once a booking has been made, the terms and conditions in force on the date on which said booking was made will apply.

3. INFORMATION PROVIDED ON THE WEBSITE www.campingcalelladepalafrugell.com:

3.1. Publication of prices: Accommodation prices are those shown at the time of initiating the booking on our website www.campingcalelladepalafrugell.com.

3.2. Accommodation information: The information appearing in our ads, brochures, other written material, our website or that provided to you, constitutes an invitation to make a purchase. The content of www.campingcalelladepalafrugell.com is constantly renewed and updated to offer our clients the most complete and detailed information possible. All contractual information present in www.campingcalelladepalafrugell.com is shown in Spanish (Castilian) and communication with clients and users, as well as contract formalisation, will be carried out in said language, although, if the client so wishes, it can be done in Catalan or another language; this must always be indicated before starting the booking process.

3.3. Accommodation availability: All available accommodation is that published. In listings where accommodation is not available, they will not appear on the web.

3.4. Bookings for the camping opening season: The hours for receiving bookings through the website made for the camping opening season is twenty-four (24) hours, 365 days. Once a booking is made, you will automatically receive an e-mail confirming the process and another confirming the purchase when the provider has received and confirmed the payment corresponding to the booking amount.

Bookings made by phone can be made between 8:00 a.m. and 9:00 p.m. during the campsite's opening season. Bookings will be confirmed when the bank transfer is made by the user; then once received, the provider will send a confirmation e-mail.

Bookings made in person can be made between 8:00 a.m. and 10:00 p.m. during the campsite's opening season.

3.5. Fraud: In case CAMPING CALELLA DE PALAFRUGELL suspects or detects any anomaly or fraud, it reserves the right to cancel the transaction for security reasons.

4. PURCHASING PROCEDURE:

In order to access the services offered by the provider, the User must register through the website by creating a User account. Only the essential information will be requested to process your booking.

Once you have selected the accommodation you wish to book, be hereby informed that in accordance with what is required by art. 27 of Law 34/2002 on Information Society and Electronic Commerce Services, the contracting procedure will follow the following steps:

4.1 Choose the desired rental by clicking on it, and it will be added to the shopping cart by clicking the "request" button.

4.2 If you want to add more bookings, please return to the "booking" option and look for the booking that best suits your request. If by mistake you add a booking that you do not want, you must click on the option "remove from my basket".

4.3 Once you have chosen the booking (s), you must click on the request tab to make the booking. By clicking on this option, a purchase confirmation will appear (summary of the bookings made, booking details, and the chosen payment method).

A series of personal data will be requested to be able to make the booking, then, the user's consent is requested to save their data. If you provide consent, information about our services and/or offers will be sent to you if you allow it, otherwise the data will be saved for future purchases only.

The spam and junk controls in your e-mail inbox should be checked and always verify that the contact details you provide are correct.

4.4 Once your data has been filled in, the total amount of the booking and the amount referring to the advance payment will appear, together with a check box that must be marked, since it is the acceptance of these General Contracting Terms and Conditions, as well as the Privacy Policy.

4.5 To finish the process, you must click on the Finish button

In any case, once the contracting procedure is completed, the provider's contracting platform will inform the user, via e-mail, regarding all the features, price, contracting date as well as booking dates.

If there is any type of error in the address provided or at any other point of the booking, you must notify it immediately to the e-mail address that will appear on the website to proceed to correct said error.

CAMPING CALELLA DE PALAFRUGELL will provide Customer Service for FREE through our contact e-mail info@campingcalelladepalafrugell.com, if you choose another alternative means of communication, the user will have to bear the particular cost of the service.

CAMPING CALELLA DE PALAFRUGELL provides you with telephone numbers in Spain subject to the cost of your telephone operator.

5. SHIPPING:

When completing the online purchase, we will send you confirmation of the advance payment and the booking details to the e-mail address you provided when making the booking. Once the full payment is made, you will receive a confirmation e-mail again.

If the purchase is by phone, we will send you an e-mail with the chosen payment method, these general contracting terms and conditions and the instructions to be able to enjoy the contracted service.

If the purchase is in person, the documents related to the booking will be delivered by hand: invoice, access cards, data and prices of the service hours, etc.

If there is an error in the data, you must immediately contact our Customer Service line at 972.615.116 or sending an e-mail to info@campingcalelladepalafrugell.com, in order to proceed with the relevant correction.

6. PRICES AND TIME LIMITS FOR OFFER VALIDITY:

All prices displayed in the store www.campingcalelladepalafrugell.com include the VAT in force at the time of booking. All prices displayed on the website are valid and will be expressed in Euros (€). Said expenses, unless expressly indicated otherwise, do not include cancellation costs.

The user will receive the booking invoice to the e-mail address provided by the user once the booking is made.

The prices applicable to each accommodation rental will be those published on the website and automatically applied by the contracting process in the last phase of the same.

For promotions of limited duration, the promotional discount will be applied as long as the booking has been registered during the promotional period.

The data recorded for the different payment methods constitute proof of the date on which the financial transactions were made, and will serve to determine whether or not said booking is subject to a promotion.

For any information about a booking, the User may contact the provider through the customer service telephone number or via e-mail to the address provided.

7. PAYMENT METHODS

Below, we describe the systems available:

For online purchases. Payment shall be by credit or debit card: Users must have a valid credit or debit card where they must specify all the numbers of their card in the corresponding form. The operation is formalised at the time of booking. We only accept payments with secure cards in which your identity as cardholder is authenticated according to the method established by your bank, through secure electronic commerce ("Verified by Visa" and "MasterCard SecureCode"). Bookings shall not be considered finalised and will not be processed until payment has been authorised by your banking entity.

We use the system called SSL (Secure Sockets Layer), a secure environment payment system as it allows the encryption of information transmitted during the transaction, ensuring confidentiality.

For telephone purchases. Payment shall be by direct debit or deposit. At the end of the call, users will receive the instructions with the account number to pay the booking deposit. It is essential that the assigned booking number and the name of the user are clearly indicated in the money transfer order. In order to confirm the booking, you need to order the money transfer within 2 days, otherwise your booking will be canceled in our system.

8. CANCELLATION AND PAYMENT CONDITIONS

Once the booking is made through the website, you will make the payment of 40% of the total amount of the stay by credit card, if it is made within more than 30 days of the arrival date. The outstanding amount has to be paid 30 days before your arrival. Otherwise, the booking will be considered cancelled. Once the full payment has been made, we will send the confirmation of the paid booking.

In case of making the online booking less than 30 days before the arrival date, the initial payment shall be 100%.

For telephone bookings, once availability is confirmed by the provider, users must pay 40% of the total amount of the stay by bank transfer within a period of 2 days, if the booking is made more than 30 days from the arrival date. The outstanding amount has to be paid 30 days before your arrival. Otherwise, the booking will be considered cancelled. Once the full payment has been made, we will send the final booking confirmation.

In case of making the booking less than 30 days before the arrival date, the initial payment shall be 100%.

If the booked accommodation is not occupied on the day of arrival or at the latest on the following day before 12 noon, the booking will be automatically cancelled, unless we have been notified of the delay in writing. There will be no refund in case of delay on the day of arrival or for early departure.

In case of cancellation, you must inform at least 30 days in advance of your arrival date, otherwise you will lose the amount paid. The total or partial cancellation costs, in cases where the refund of the amount paid is appropriate, will be € 20 that will be deducted from the amount thereof. Cancellations must be requested in writing by email to info@campingcalelladepalafrugell.com.

9. TERMS AND CONDITIONS OF STAY

The accommodation can be occupied on the day of arrival from 4:00 p.m., and must be vacated on the scheduled departure day before 10:00 a.m. On dates of maximum occupancy of the accommodations, the time of entry may be delayed.

The site can be occupied from 12 noon on the day of arrival and must be vacated on the scheduled day of departure before 12 noon.

When the Client leaves the accommodation/site before the date until which it was booked, the Campsite will keep the 100% of the total price of the remaining services to use.

Tourist tax will be applied according to current legislation and will be paid at the reception desk upon arrival.

Pets are not allowed at the campsite.

Once a booking is formalised, the Management undertakes to reserve the number of accommodations or sites requested, without being able to guarantee the exact location. The booking only confers the right to occupy a given place and does not confer any other privilege.

The provider will not be responsible for booking errors attributable to the user or caused by unavoidable and extraordinary circumstances.

10. NULLITY AND VOID CLAUSES:

If any provision included in these General Terms and conditions were to be declared fully or partially null or void, this shall only affect said provision or the part thereof which is deemed null or void, with all other Terms and conditions remaining in force, with said provision or part thereof being affected.

11. ONLINE DISPUTE RESOLUTION:

Pursuant to Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for the resolution of online conflicts between the User and the PROVIDER, without the need to resort to the courts of law, through the intervention of a third party, called the Dispute Resolution Body, which acts as an intermediary between them. This body is neutral and will dialogue with both parties to reach an agreement, and may ultimately suggest and/or impose a solution to the conflict. 12. APPLICABLE LAW AND JURISDICTION:

These terms and conditions shall be governed by or interpreted in accordance with Spanish law in all matters not expressly stated. Provider and user agree to submit any controversy that may arise from the provision of the service subject matter of these Terms and Conditions, to the Courts and Tribunals of the provider's domicile (when not considered a consumer for the purposes of the TRLGDCU (Law on consumer protection)) or the user (when considered a consumer for the purposes of the TRLGDCU).

13. APPLICABLE REGULATIONS:

These General Terms and Conditions are subject to the provisions of:

13.1 European regulations governing electronic commerce:

· Directive 97/7 /EC on the protection of consumers in respect to distance contracts (Distance Selling Directive);

· Directive 2000/31/EC on certain legal aspects of information society services, in particular, electronic commerce in the internal market (Directive on electronic commerce).

13.2 Spanish regulations:

· Law 3/2014, of 27 March, amending the revised text of the General Law for the Protection of Consumers and Users.

· Law 7/1998, of 13 April, on General Contracting Conditions, and subsequent amendments.

· REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 concerning the protection of natural persons with regard to the processing of personal data and the free movement of such data and repealing Directive 95/46 /EC (General Data Protection Regulation),

· Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights,

· Law 7/1996, of 15 January on the Regulation of Retail Trade,

· Law 34/2002 of 11 July on Services of the Information Society and Electronic Commerce and subsequent amendments.

· DECREE 75/2020, of 4 August on tourism in Catalonia.
